Ben is a commercial litigator specializing in complex litigation and class actions. He has extensive experience litigating consumer protection and privacy issues; contractual, partnership and licensing disputes; and venture capital disputes.
Ben spent almost 20 years as an associate then partner at Cooley LLP, based in New York and San Francisco, before leaving the firm in September 2023 to found Kleine PC.
Ben obtained his JD from New York University School of Law. Before law school, Ben obtained a B.A. from Brown University and a M.A. from University of Chicago.
Ben has taken numerous cases to trial and handled some of the most high profile class actions. Some representative matters include:
- Numerous data breach litigations involving companies including eBay, LinkedIn, Planet Hollywood, Solera, Caliber Home Loans, Boys Town Hospitals, Ethos Technologies, and Metromile.
- Represent Zoom Video Communications in privacy-related litigations and other disputes.
- Represented Facebook in numerous privacy and user class action litigation
- Represented Oculus VR in founder dispute and trademark infringement lawsuit.
- Represented Twitter in class action relating to alleged bot activity on Twitter.
- Represented Credit Karma in class action alleging violation of Telephone Consumer Protection Act.
- Represented augmented reality company Niantic in Pokemon Go-related class actions.
- Represented car sharing company Turo in lawsuits brought by numerous airports including San Francisco, Los Angeles, Tampa, and Dallas-Fort Worth challenging Turo users’ activities at the airports.
- Represented American Century mutual fund companies in numerous derivative lawsuits challenging the funds’ investments in offshore gambling companies.
- Represented computer memory manufacturer SanDisk in contractual dispute with Dolby and Arcsoft.
- Represented Harpoon Therpeutics in a contractual and fraud lawsuit against Takeda Pharmaceuticals.
- Represented Onyx Pharmaceuticals. in a contractual lawsuit against international pharmaceutical giant, Bayer Pharmaceuticals, arising out of the parties’ anti-cancer drug collaboration.
- Represented XM Satellite Radio in copyright infringement lawsuits brought by the RIAA member companies and music publishing companies based on XM users’ ability to record broadcasts on XM devices.
- Represented social media company Hi5 Networks in a copyright infringement lawsuit brought by record labels based on user upload activity.
